These Terms of Use govern access to and use of the Ticker8 website, subscriber dashboard, forecasts, alerts, reports, emails, applications and other services made available under the Ticker8 name.
In these Terms:
- “Ticker8,” “we,” “us” and “our” refer to the business identified above.
- “You” and “your” refer to the person accessing or purchasing the services.
- “Services” includes the website, forecasts, classifications, alerts, subscriber content and any related paid or free features.
- “Content” includes forecasts, classifications, scores, tables, written analysis, graphics, alerts, data, software and other material made available through Ticker8.
By creating an account, purchasing access, clicking an acceptance box or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use any paid Ticker8 service.
By using the Services, you confirm that:
- The information supplied during registration is accurate and current.
- You are using the Services for lawful purposes.
- Access to the Services is lawful in the country or jurisdiction where you are located.
- You have authority to accept these Terms if acting for a business or other organisation.
Ticker8 may refuse access in a jurisdiction where offering the Services would be unlawful or would create regulatory obligations that Ticker8 is not authorised to undertake.
2. Description of the Services
Ticker8 may provide services including:
Next Trading Day Sector Strength Forecast
A forecast classifying major U.S. market sectors as Strong, OK or Weak for an upcoming U.S. trading session.
Current Sector Strength
Automatically updated classifications showing current sector conditions while the U.S. market is open.
Previous-Day Touch Alerts
Alerts indicating when a selected security moves above or below the previous trading day’s high or low, or returns inside a previous-day price range.
Free content
Selected historical forecasts, educational material, market observations, sample content or limited previews.
Future services
Additional analytical tools, alerts and market-information services may be introduced later.
The availability, features, publication schedule and price of each Service will be displayed on the relevant product or pricing page.
3. No personal advice
Ticker8 does not collect or assess your complete personal objectives, financial situation, financial needs, risk tolerance, tax position or investment experience when producing general website content and sector classifications.
The Services are not personalised for you.
Nothing provided through Ticker8 should be treated as:
- Personal financial advice
- Legal advice
- Tax advice
- Accounting advice
- A personal recommendation
- A promise that a security or sector will rise or fall
- A direction to enter, exit or remain in a trade
- A substitute for your own research and professional advice
Before acting on any information, consider whether it is appropriate for your circumstances and obtain professional advice where necessary.
4. No brokerage or trading service
Ticker8 is not a stockbroker and does not execute trades through the Services.
Unless a future feature expressly states otherwise, Ticker8 does not:
- Hold subscriber funds
- Hold securities for subscribers
- Operate a trading account
- Place orders
- Control a subscriber’s brokerage account
- Manage an investment portfolio
- Monitor an individual subscriber’s financial circumstances
- Guarantee that an alert will arrive before a market movement
You remain solely responsible for every trading and investment decision.
5. Meaning of sector classifications
Ticker8 classifications describe an analytical assessment of broader sector conditions at the time the forecast is prepared.
Strong
A Strong classification means that a sector appears to have comparatively favourable conditions under the Ticker8 methodology.
It does not mean that:
- Every security in the sector will rise.
- The sector will outperform every other sector.
- A particular trade should be entered.
- The classification will remain valid throughout the session.
OK
An OK classification means that conditions appear mixed, neutral or insufficiently strong or weak to receive another classification.
Individual securities within an OK sector may rise or fall significantly.
Weak
A Weak classification means that a sector appears to have comparatively unfavourable conditions or reduced relative strength.
It does not mean that:
- Every security in the sector will fall.
- Short selling is appropriate.
- Losses are certain.
- The classification will remain valid throughout the session.
The classifications are analytical opinions or outputs, not guarantees of future market behaviour.
6. Forecast methodology
Ticker8 may consider multiple categories of information, including:
- Sector price behaviour
- Relative strength
- Momentum
- Market participation
- Trading volume
- Broader market conditions
- Relevant market events
- Other quantitative or qualitative information
The precise formulas, scoring rules, thresholds, weightings, software logic and internal review procedures are proprietary.
Ticker8 is not required to disclose information that would reveal or enable reconstruction of its proprietary methodology.
Descriptions of the general analytical process are provided for transparency but do not give subscribers any right to access source code, internal calculations, unpublished datasets or confidential business information.
7. Forecast limitations
Financial markets are uncertain and may change rapidly.
A forecast may become less relevant or inaccurate because of events occurring before or during the trading session, including:
- Economic announcements
- Interest-rate decisions
- Government announcements
- Earnings reports
- Company announcements
- Geopolitical events
- Commodity-price movements
- Currency movements
- Market-data errors
- Unexpected news
- Pre-market or after-hours trading
- Changes in market sentiment or liquidity
- Trading halts or exchange interruptions
Ticker8 does not guarantee:
- Forecast accuracy
- Profitable results
- Protection against losses
- Particular sector performance
- Timely receipt of every alert
- That historical relationships will continue
- That a classification will remain valid throughout a session
- That every relevant event has been identified
- Continuous or uninterrupted availability
Past performance does not guarantee future results.
8. Publication schedule
The expected publication schedule for each forecast will be displayed on the website or subscriber dashboard.
Publication dates and times may be shown in New York time, or other country time.
Subscribers are responsible for confirming:
- The trading session covered
- The applicable time zone
- Whether daylight-saving time is in effect
- The forecast’s publication time
- The period during which access remains available
Ticker8 may publish earlier or later than the usual time when reasonably necessary because of market schedules, public holidays, data availability, technical problems or events outside reasonable control.
9. Corrections and updated information
Ticker8 may correct:
- Typographical errors
- Formatting errors
- Incorrect labels caused by a technical problem
- Market-data processing errors
- Incorrect publication dates or session references
- Other genuine errors
A material correction should be clearly identified and time-stamped where reasonably practicable.
Ticker8 will not alter a historical forecast merely to make its results appear more favourable after the relevant market session.
Market commentary added after the original publication should be identified as an update rather than presented as part of the original forecast.
10. Accounts and login security
Some Services require a registered account.
You agree to:
- Provide accurate registration information.
- Maintain only one account unless additional accounts are authorised.
- Keep login credentials confidential.
- Use a strong and secure password.
- Notify Ticker8 promptly if unauthorised access is suspected.
- Keep account and payment information current.
- Accept responsibility for activity occurring through your account where caused by your failure to protect the account.
Accounts may not be sold, transferred, shared or made available to another person.
Ticker8 may require reasonable identity or account verification when investigating suspected unauthorised use.
11. Personal-use licence
Subject to these Terms and payment of the applicable fee, Ticker8 grants you a limited, revocable, non-exclusive, non-transferable licence to access the purchased Content for your own personal trading research or internal business research.
This licence does not transfer ownership of any Content or intellectual property.
Unless written permission is provided, you must not:
- Share paid forecasts with non-subscribers.
- Forward subscriber emails or alerts.
- Publish screenshots of paid Content.
- Reproduce classifications on another website or social-media account.
- Resell or redistribute Content.
- Create a competing forecast or alert service using Ticker8 Content.
- Use Content as part of a paid trading group, signal service or newsletter.
- Scrape, harvest or automatically extract Content.
- Bypass access controls or payment restrictions.
- Reverse engineer software, calculations or methodology.
- Attempt to derive proprietary formulas or weightings.
- Use Content to train or develop an artificial-intelligence or machine-learning system.
- Remove copyright, trade mark or ownership notices.
Brief references to Ticker8 for genuine private discussion or review may be permitted where they do not reproduce a substantial part of paid Content or disclose an upcoming subscriber-only forecast.
12. Acceptable use
You must not use the Services:
- Unlawfully or fraudulently
- To impersonate another person
- To interfere with the website or another subscriber’s access
- To upload malicious code
- To conduct vulnerability testing without permission
- To obtain unauthorised access to servers, accounts or databases
- To overwhelm the Services with automated requests
- To manipulate performance records
- To make misleading statements about Ticker8 forecasts
- To infringe intellectual-property, privacy or other rights
- To assist another person in breaching these Terms
Reasonable technical measures may be used to detect account sharing, scraping, unusual login activity or other misuse.
13. Intellectual property
Ticker8 and its licensors retain all rights in:
- The Ticker8 name and branding
- Website design and content
- Forecast formats
- Classification systems
- Written analysis
- Databases
- Software
- Algorithms
- Scoring systems
- Alert logic
- Research processes
- Historical forecast records
- Graphics and reports
Nothing in these Terms grants permission to register, use or imitate Ticker8 branding, domain names or confusingly similar marks.
14. Plans and prices
Ticker8 may offer:
- One-day access
- Monthly subscriptions
- Annual subscriptions
- Separate service packages
- Promotional or trial access
- Other access periods displayed during checkout
The price, currency, billing period and included features will be shown before payment.
Prices may include or exclude GST and other applicable taxes as stated during checkout.
You are responsible for reviewing the selected plan before completing payment.
15. One-day access
One-day access:
- Covers the forecast or session identified during checkout.
- Is a one-time purchase.
- Does not renew automatically.
- Expires at the time stated on the product page or subscriber dashboard.
- Does not include access to other forecasts unless expressly stated.
Failure to open or use the purchased forecast does not extend the access period or create an automatic entitlement to a refund.
16. Automatically renewing subscriptions
Monthly and annual subscriptions automatically renew unless cancelled before the next billing date.
By starting an automatically renewing subscription, you authorise the applicable payment provider to charge the displayed subscription price and applicable taxes at each renewal.
Before purchase, the checkout page should clearly display:
- The amount payable
- The billing frequency
- Whether the subscription renews automatically
- The next renewal arrangement
- How to cancel
- Any minimum commitment
- The applicable Refund and Cancellation Policy
Monthly subscriptions normally renew each month.
Annual subscriptions normally renew every twelve months.
The next billing date should be available through the subscriber account or payment-management page.
Automatic-renewal and cancellation information should also be displayed prominently during checkout rather than being available only in these Terms.
17. Cancelling a subscription
You may cancel an automatically renewing subscription:
- Through the subscriber account or billing portal; or
- By contacting via this page where dashboard cancellation is unavailable.
Cancellation prevents the next renewal charge.
Unless otherwise required by law or stated on the relevant plan:
- Cancellation does not provide a refund for the current billing period.
- Access continues until the end of the period already paid for.
- There is no cancellation fee.
- No partial refund is provided for unused days.
You should cancel before the displayed renewal date. Requests submitted after a renewal has already been processed will be handled under the Refund and Cancellation Policy and applicable law.
18. Price changes
Ticker8 may change subscription prices.
For an existing automatically renewing subscription:
- Reasonable advance notice will be provided before a price increase takes effect.
- The new price will apply from a future renewal date.
- You may cancel before that renewal if the new price is not accepted.
A price change will not ordinarily increase the amount already paid for the current access period.
19. Refunds
Purchases are subject to the separate Refund and Cancellation Policy, which forms part of these Terms.
Except where required by applicable law:
- Purchases are not refundable for change of mind.
- Forecast outcomes do not create a refund entitlement.
- Trading losses do not create a refund entitlement.
- Failure to use the Services does not create a refund entitlement.
- Cancellation does not produce a partial refund for the current billing period.
- An inaccurate classification, by itself, does not establish that the Service was not supplied as described.
Nothing in these Terms or the Refund and Cancellation Policy excludes rights or remedies that cannot lawfully be excluded.
20. Payment processing
Payments may be processed by an independent payment provider.
Use of a payment provider may also be subject to that provider’s terms and privacy policy.
You authorise the payment provider to process charges associated with the selected plan.
You must not use:
- Stolen payment information
- An account that you are not authorised to use
- False billing details
- A payment dispute or chargeback to avoid a valid contractual payment
Suspected duplicate or incorrect charges should first be reported via this page so that they can be investigated promptly.
21. Free content, trials and promotions
Free Content, trial access and promotional offers may:
- Be limited by time, features or availability.
- Be offered only to eligible new users.
- Be changed or withdrawn before acceptance.
- Have separate conditions displayed with the offer.
- Exclude certain Services.
Where a free trial converts into a paid subscription, the conversion date, price and cancellation method must be displayed before enrolment.
Historical or sample forecasts do not guarantee that future forecasts will achieve similar results.
22. Third-party information
Ticker8 may use or display information obtained from third-party market-data providers, exchanges, financial websites, software providers or other sources.
Third-party information may be:
- Delayed
- Incomplete
- Incorrect
- Temporarily unavailable
- Subject to correction
- Governed by separate licensing restrictions
Ticker8 may reasonably rely on third-party information but cannot guarantee that every external source is complete or error-free.
References or links to third-party websites do not necessarily indicate endorsement.
You are responsible for reviewing the terms and risks associated with any third-party service.
23. Service availability
Ticker8 aims to provide reliable access but does not promise uninterrupted operation.
Access may be affected by:
- Scheduled maintenance
- Emergency maintenance
- Hosting outages
- Internet failures
- Market-data outages
- Software defects
- Cybersecurity incidents
- Payment-provider failures
- Email or notification delays
- Events outside reasonable control
Where a material problem caused by Ticker8 prevents delivery of a paid Service, Ticker8 may provide an appropriate remedy, such as restored access, an extension, account credit, replacement access or another remedy required by law.
24. Changes to the Services
Ticker8 may add, improve, replace or discontinue features where reasonably necessary.
Material reductions to a paid Service will not be made arbitrarily.
Where a material change substantially reduces the Service during a prepaid period, Ticker8 will consider an appropriate remedy having regard to:
- The extent of the change
- The remaining access period
- The reason for the change
- Applicable consumer rights
Future services displayed as “coming soon,” “planned” or “under development” are not guaranteed to launch by a particular date unless an express written commitment is provided.
25. Suspension and termination
Ticker8 may suspend or terminate access where reasonably necessary because:
- Payment is overdue or reversed.
- Fraud is suspected.
- An account is being shared.
- Content is being copied or redistributed.
- Automated scraping is detected.
- The Services are being attacked or disrupted.
- These Terms have been materially breached.
- Continued access would create a security, legal or regulatory risk.
Where appropriate, a reasonable opportunity may be provided to correct the problem before permanent termination.
Immediate suspension may be used where necessary to protect subscribers, systems, intellectual property or legal interests.
Termination for subscriber misconduct does not automatically entitle the subscriber to a refund.
26. Subscriber feedback
Feedback, error reports and suggestions are welcomed.
By submitting feedback, you permit Ticker8 to use the feedback to improve its Services without payment or obligation, provided that personal information is handled in accordance with the Privacy Policy.
Ticker8 will not knowingly publish your name or identify you publicly in connection with feedback without permission.
27. Privacy
Personal information is handled in accordance with the Ticker8 Privacy Policy.
The Privacy Policy should explain:
- What information is collected
- Why it is collected
- How it is used
- Which service providers may receive it
- How account and payment data are handled
- How users can request access or correction
- How privacy enquiries and complaints can be submitted
By using the Services, you acknowledge that information may be processed by hosting, payment, email, analytics and security providers as described in the Privacy Policy.
28. Electronic communications
You agree that notices relating to your account, payments, security and Services may be delivered electronically, including through:
- The subscriber dashboard
- Website notices
- Billing-provider notifications
You are responsible for maintaining a valid email address and checking spam or junk folders.
Marketing communications will include an unsubscribe method where required.
Account, billing, security and legal notices may still be sent after marketing communications have been unsubscribed from.
29. Consumer rights
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.
Where a non-excludable guarantee applies, the available remedy will depend on:
- The nature of the Service
- The nature and seriousness of the failure
- The loss caused
- The requirements of applicable law
These Terms must not be interpreted as stating that refunds or other remedies are unavailable in every circumstance.
Australian consumer guarantees cannot be removed by a contract or a general “no refunds” statement, and standard-form consumer contracts are also subject to unfair-contract-term laws.
30. Disclaimer of warranties
Subject to any rights that cannot lawfully be excluded, the Services are provided on an “as available” basis.
Ticker8 does not make an express warranty that:
- The Services will be uninterrupted or error-free.
- Every data source will be accurate.
- Every forecast will be correct.
- Every alert will be received immediately.
- The Services will meet every subscriber’s expectations.
- Use of the Services will result in profits.
- Use of the Services will prevent trading losses.
No statement on the website should be interpreted as a guarantee unless it is expressly identified as a contractual guarantee.
31. Responsibility for trading decisions
You acknowledge that:
- Trading and investing involve risk.
- Market prices can change rapidly.
- You may lose some or all capital committed to a trade.
- Sector performance does not determine the performance of every security within that sector.
- Alerts may occur after a rapid price movement has already begun.
- Technical or market conditions may prevent execution at an expected price.
- Leverage, options, short selling and margin can increase risk.
- Forecast information should not be the sole basis for a trading decision.
You remain responsible for assessing entry price, position size, liquidity, volatility, risk limits, stop-loss arrangements and all other aspects of a trade.
32. Limitation of liability
Nothing in this section limits liability where doing so would be unlawful.
To the maximum extent permitted by law, Ticker8 is not responsible for trading or investment losses arising from an independent decision to trade or invest based on market information provided through the Services.
Ticker8 is also not responsible for loss caused solely by:
- Market movements
- A broker or exchange
- Internet or device failure outside Ticker8’s control
- A third-party data outage
- Failure to protect account credentials
- Use of Content in breach of these Terms
- Events occurring after a forecast was published
Where liability can lawfully be limited, Ticker8’s aggregate liability relating to a paid Service will not exceed the amount paid for that Service during the twelve months immediately preceding the event giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited, including liability arising from fraud, deliberate misconduct or another matter excluded from limitation by law.

34. Changes to these Terms
Ticker8 may update these Terms to reflect:
- Changes to the Services
- Legal or regulatory requirements
- Security requirements
- Payment or technical changes
- Reasonable business changes
Material changes will be communicated through the website, subscriber account or email before taking effect where reasonably practicable.
A material change affecting an existing paid subscription will ordinarily apply from the next renewal unless earlier application is required by law, security needs or another compelling reason.
Continuing to use the Services after updated Terms take effect constitutes acceptance of the updated Terms.
If a material change is not accepted, an automatically renewing subscription may be cancelled before the change takes effect.
35. Governing law
These Terms are governed by the laws of Australia.
The parties submit to the courts of that State or Territory and any courts entitled to hear appeals from them.
Nothing in this clause prevents a consumer from relying on a right to bring a claim in another jurisdiction where that right cannot lawfully be excluded.
36. General provisions
Entire agreement
These Terms, the Refund and Cancellation Policy, Privacy Policy, Risk Disclosure and any plan-specific conditions form the agreement concerning use of the Services.
Severability
If a provision is found to be unlawful or unenforceable, it will be removed or limited to the minimum extent necessary. The remaining provisions will continue to apply.
No waiver
Failure to enforce a provision immediately does not waive the right to enforce it later.
Assignment
You may not transfer your account or rights under these Terms without written permission.
Ticker8 may transfer its rights and obligations as part of a genuine business sale, restructure or transfer, provided that doing so does not materially reduce subscriber rights.
